August 24: Public Hearings on Nuisance Odors from Miramar Landfill

Public Notice re Miramar Landfill Hearings 8-24-17 and 9-07-2017

As you may be aware, the Air Pollution Control District (District) has received and investigated odor complaints regarding Miramar Landfill, operated by the City of San Diego.

The District’s request for an abatement order requiring that the City of San Diego’s Miramar Landfill cease causing an odor nuisance was originally scheduled to be heard by the Air Pollution Control District Hearing Board on May 25, 2107.  The Hearing Board, however, has continued the hearing to allow the City of San Diego to develop an action plan to prevent future odors that can constitute a public nuisance.  The following hearings have been scheduled:

  1. Thursday, August 24th at 9:00 am: City of San Diego to provide a status update on the action plan to the Hearing Board.
  2. Thursday, September 7th at 9:00 am: Petition for abatement order to be heard.

The above hearings will take place in Room 358 of the San Diego County Administration Center, located at 1600 Pacific Highway in San Diego.  Hearing Board meetings are open to the public, and anyone may attend.  The Hearing Board allows public testimony at the hearing, and may accept written comments submitted to the Clerk of the Hearing Board, 1600 Pacific Highway, Room 402, San Diego, CA 92101, by 5 p.m. by Wednesday, August 30, 2017.

Public parking for the Board hearing is available in the underground parking structure, with the entrance located on Ash Street. Please note the parking regulations posted in the garage. In the event that public parking is full, you may wish to park in metered spaces around the building (on North Harbor Drive or Pacific Highway).

If the Hearing Board approves the abatement order, the City of San Diego would be ordered to not create a public nuisance in accordance with District Rule 51 (nuisance) and California Health and Safety Code section 41700 (nuisance).
